You should never accept payment from the owner of the vehicle that hit you...too many things can go wrong with it. What if he gives you a check, you take your car to a shop and there's more damage? He's already paid and you accepted so his responsibility has been met and you are out the additional expense. What about a rental while your car is being repaired?
